Terms & Conditions for HANSEN’S PLUMBING & MAINTENANCE

Welcome to www.hansen247plumbing.com (the “Website”), operated by HANSEN’S PLUMBING & MAINTENANCE (“we”, “us”, “our”, or “Company”), a private company registered in the Republic of South Africa with registration number 00000000 By accessing or using our Website, requesting a quotation, booking a service, or engaging our plumbing services, you agree to be bound by these Terms & Conditions (“Terms”) in accordance with South African law. If you do not agree, do not use the Website or our services.

1. Use of the Website

  • You must be 18 years or older and have full legal capacity to contract under South African law.

  • You agree to provide accurate, current, and complete information when requesting quotes, booking appointments, or contacting us.

  • You are responsible for keeping any account login details confidential.

2. Services

  • Quotations & Estimates: All quotes are estimates based on information supplied. Final pricing may change after on-site inspection due to unforeseen conditions (e.g., hidden pipe damage, compliance with SANS 10162, material shortages). We will obtain your approval before proceeding with additional work.

  • Scheduling: Appointment times are approximate. We are not liable for delays caused by traffic, emergencies, load-shedding, weather, or supply-chain disruptions.

  • Payment:

    • Payment is due on completion unless credit terms are pre-approved in writing.

    • Accepted methods: cash, EFT, debit/credit card, or approved mobile payment.

    • A 3% card surcharge may apply to payments over R5 000.

    • Overdue invoices accrue interest at prime + 2% per month from the due date.

  • Deposits: Required for jobs exceeding R10 000 or special-order materials. Deposits are non-refundable if cancelled within 24 hours of the scheduled start.

3. Workmanship & Guarantee

  • Guarantee: Labour and parts installed by us are guaranteed for 6 months from the completion date, subject to:

    • Drain clearing: 30 days

    • Customer-supplied materials: no guarantee

    • Issues arising from misuse, neglect, or pre-existing defects

  • Guarantee covers repair or replacement at our discretion and excludes consequential loss (e.g., water damage, business interruption).

  • The guarantee is void if full payment is not received.

4. Customer Responsibilities

  • Provide safe, clear access to work areas (remove valuables, secure pets, clear clutter).

  • Disclose known hazards (e.g., asbestos, aggressive dogs, unstable structures).

  • Obtain NHBRC or local authority approvals where required, unless we agree in writing to handle the same.

  • Ensure water and electricity are available (load-shedding contingencies remain your risk unless backup power is arranged).

5. Cancellations & No-Shows

  • Cancel or reschedule at least 24 hours in advance to avoid a R750 call-out fee.

  • Same-day cancellations or no-shows may be charged up to 50% of the quoted amount.

6. Liability & Limitations

  • We are not liable for:

    • Damage to concealed services not reasonably detectable or disclosed.

    • Pre-existing defects, corrosion, or non-compliance with SANS standards discovered during work.

    • Delays caused by third parties (e.g., municipal inspectors, suppliers).

  • Total liability is limited to the amount paid for the specific service.

  • We hold public liability insurance and COIDA registration. Certificates available on request.

7. Property Damage

  • We take reasonable care but accept no liability for minor cosmetic damage (e.g., paint scuffs, tile chips) inherent to accessing plumbing.

  • Report any damage within 24 hours of completion.

8. Emergency Call-Outs

  • 24/7 emergency service is available at 1.5× standard rates after 18:00, weekends, or public holidays.

  • Response times are prioritised but not guaranteed.

9. Consumer Protection Act 68 of 2008 (CPA)

  • Where the CPA applies, these Terms are subject to sections 48–52 (fair pricing & estimates) and section 54 (reasonable quality & safety).

  • You may cancel without penalty up to 5 business days before a fixed-term service agreement starts (section 14), subject to a reasonable cancellation charge 15%.

10. Protection of Personal Information Act 4 of 2013 (POPIA)

Your personal data is processed in accordance with our Privacy Policy. We do not sell your data.

11. Intellectual Property

  • All Website content (text, images, logos) is protected by South African copyright law. Unauthorised use is prohibited.

  • We may use anonymised photos of completed work for marketing unless you opt out in writing.

12. Dispute Resolution

  • Governing Law: Laws of the Republic of South Africa.

  • Step 1 – Informal: Email Peterhansen11771234@gmail.com. We respond within 30 business days.

  • Step 2 – Mediation: If unresolved, refer to the National Consumer Commission or an accredited ombud.

  • Step 3 – Court: Magistrate’s Court in [Your Magisterial District] has jurisdiction, notwithstanding claim value.

  • No class actions – disputes are resolved individually.

13. Amendments

We may amend these Terms at any time. Changes are effective upon posting. Continued use constitutes acceptance.
